Terms and Conditions of Sale

These terms and conditions of sale (hereinafter "Terms") govern the sale of products made on the CLENZA website (hereinafter "the Site"), operated by CLENZA, represented by Scott Dissake. Any order placed on the Site implies unreserved acceptance of these Terms by the customer (hereinafter "the Customer").

Article 1 – Purpose

These Terms are intended to define the rights and obligations of the parties in connection with the online sale of products offered by CLENZA, namely home cleaning accessories and devices.

Article 2 – Products

The products offered for sale are those listed on the Site on the day the Customer visits it, subject to availability. Each product is accompanied by a description covering its essential characteristics. Photographs illustrating the products have no contractual value.

Article 3 – Price

Product prices are indicated in euros (€). CLENZA operates under the French micro-entreprise regime and benefits from the VAT exemption threshold: VAT not applicable, Article 293 B of the French General Tax Code. Displayed prices are therefore net of tax. CLENZA reserves the right to change its prices at any time, it being understood that the price shown on the Site on the day of the order will be the only one applicable to the Customer. Shipping costs are shown before the order is finally confirmed and are added, where applicable, to the price of the products.

Article 4 – Order

The Customer selects the products they wish to order, adds them to their cart, and then confirms their order after checking its contents and total price. The order is only final once payment has been confirmed. A confirmation email summarizing the order details is sent to the Customer at the address provided when placing the order.

Article 5 – Payment

Payment is made online, at the time of ordering, by credit card or any other payment method offered on the Site. Transactions are secured via the Shopify platform and its payment providers. The order will only be considered confirmed once approval from the banking payment centers has been received.

Article 6 – Delivery

Delivery terms, timeframes, and zones are detailed in our Shipping Policy, which forms an integral part of these Terms.

Article 7 – Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product(s) to exercise their right of withdrawal, without having to justify any reason or pay any penalty, except, where applicable, for return shipping costs. The terms for exercising this right are detailed in our Right of Withdrawal and Return Policy.

Article 8 – Legal Warranties

All products sold on the Site benefit, as a matter of right and at no extra cost, in accordance with legal provisions, from:

  • the legal warranty of conformity, provided for in Articles L.217-3 et seq. of the French Consumer Code, for a period of two (2) years from delivery of the product;
  • the legal warranty against hidden defects, provided for in Articles 1641 et seq. of the French Civil Code.

Under the legal warranty of conformity, the Customer may choose between repair and replacement of the product, subject to the cost conditions set out in Article L.217-9 of the French Consumer Code. The Customer is not required to prove the existence of the lack of conformity during the twenty-four (24) months following delivery of the product. Article 9 – Liability

CLENZA cannot be held liable for non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, total or partial disruption or strike affecting postal services or means of transport, or in the event of abnormal, negligent, or non-compliant use of the product by the Customer.

Article 10 – Personal Data

The processing of the Customer's personal data in connection with their order is described in our Privacy Policy.

Article 11 – Mediation

In accordance with Article L.616-1 of the French Consumer Code, in the event of a dispute, the Customer may use a consumer mediator free of charge to seek an amicable resolution of the dispute. The contact details of the competent mediator are provided in our Legal Notice. The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 12 – Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, French courts shall have sole jurisdiction, subject to procedural rules applicable to consumer protection.
